Prosecution office requests permission to investigate head of Turkish Capital Markets Board

The Istanbul Chief Public Prosecutor' s Office, specifically its department for the investigation of money laundering offences, has taken a significant new step in an ongoing inquiry into investment funds.

The prosecution has formally applied to the Ministry of Treasury and Finance for authorisation to launch an investigation into İbrahim Ömer Gönül, who serves as the chairman of Turkey’s Capital Markets Board (SPK). The request for investigation concerns allegations of ' misconduct in public office' (görevi kötüye kullanma).

The prosecution asserts that there are ' clear and sufficient indications' that Gönül has failed to fulfil his duties and responsibilities regarding the regulation and supervision of investment funds. The Capital Markets Board (SPK), or Sermaye Piyasası Kurulu, serves as Turkey' s central regulatory authority for the capital markets.

Its primary mandate is to ensure the fair and efficient operation of these markets, to protect the interests of investors, and to provide oversight of investment funds.

The SPK plays a pivotal role in maintaining confidence in the Turkish financial system, which remains essential for both domestic and international investors. This case highlights an important legal procedure for Turkish officials.

In order to initiate a criminal investigation against high-ranking public servants, such as the chairman of the SPK, formal permission must be granted by a superior authority.

In this instance, it is the Ministry of Treasury and Finance (Hazine ve Maliye Bakanlığı) that must provide the green light before any formal investigation can proceed.

This system is designed to protect officials from baseless accusations while simultaneously ensuring that serious misconduct can be investigated when necessary. An investigation request against the head of such a critical financial regulator is a significant event for Turkey' s financial sector.

It touches upon fundamental questions regarding the integrity and effectiveness of oversight within the country' s investment markets.
